Terms & Conditions

The Terms and Conditions contained within this contract constitutes the ‘Agreement’ between the associates and employees of ‘Ferme du Ciel’ (herein referred to as ‘We’, ‘Us’, ‘Our’) and ‘The Client’ (herein referred to as ‘You’, ‘Your’).

The `Lead’ signature and those detailed on the booking form is confirmation that these Terms and Conditions have been read, and are fully understood and accepted by all. This ‘Contractual Agreement’ is enforced by law of France.  Accordingly, by proceeding to confirm your booking and making the appropriate payment; you are agreeing to be legally bound by the terms of this ‘Agreement’.

  1. Our Service

We will provide and arrange food and accommodation at Ferme du Ciel and other requested services as detailed on the http://www.fermeduciel.com/ website following confirmation of your holiday booking and once all costs of your holiday have been received in full.

  1. Making a booking.

Bookings can be made either by telephone, message or by e-mail.  A written form by you confirms the reservation, however the booking and contract between you and us is not formally confirmed until we have received your deposit.

  1. Payment

i) 25% of the holiday price is payable immediately upon your confirmation of booking. The remaining balance of the Total Package Price (including any additional extras or modifications omitted from the initial booking confirmation) is payable in full no later than eight (8) weeks prior to arrival.

ii) If you are booking within 8 weeks of the date of departure, full payment should be made at the time of booking. All our holiday prices are in (€) However, if a quote has been provided in an alternative currency, then the exchange rate at close of business on the day that the quote was provided, shall be used from that point on to convert to (€) EUR. We reserve the right to pass on any bank charges incurred as a result of receiving payment in currencies other than (€) EUR.

iii)  Your confirmation of booking and receipt of payment will be issued by us, once received.

iv) Your documentation should be carefully checked and we should be informed of any corrections, omissions and additional requirements within 10 (ten) days of booking confirmation, as it may not be possible to facilitate changes at a later date.

v) The ‘Lead’ name of the Client whose signature appears on the booking form must be 18 years or above.

vi) If Final Payment is not received by the due date, Ferme du Ciel reserves the right to cancel the reservation without further notice, retaining deposits and the right to levy cancellation charges.

  1. Disclaimer

Whilst we will make every effort to ensure you have a safe and enjoyable holiday, we reserve the right to state the following:

i) We are not responsible for loss or damage to personal property, including injury, caused through mis-use of drink or drugs by the client(s).

ii) We are not responsible for loss or damage to personal property, including injury, caused by negligent or reckless acts whilst in or on the premises.

iii)  We are not responsible for loss or damage to personal property whilst left outside your care and control in or on the premises.

iv) We are not responsible for loss or damage to personal property, including injury or death, caused by partaking in outdoor pursuits and activities.

v) We are not responsible for loss or damage to personal property, including injury, caused by improper or inappropriate use of the Sauna or Jacuzzi.

  1. Client Responsibilities.

i) For your safety and convenience, please adhere to all Warnings and Information notices displayed in and around the premises.

ii) If you are making this booking on behalf of any person other than (or including) yourself, please make known to all members of your party the content of this agreement.

iii)  Please exercise proper care and control of your children whilst in or on the premises.

iv) Please advise (as requested on the booking form) of any known food allergies prior to arrival.

v) Please tell us, in writing, of any member(s) of your party suffering from any medical condition(s) or disabilities likely to affect the enjoyment of their stay at Ferme Du Ciel.

vi) Unless otherwise agreed, you may Check In no earlier than 16.00 hrs (local) on your arrival day and vacate your rooms by 10.00 hrs (local) on your departure day.

vii) You will be bound by the operating conditions of suppliers and other service providers that you have requested during your holiday in respect of cancellation, loss, delay or costs incurred due to adverse weather, traffic, avalanche, snow and mud slide conditions affecting travel and accommodation arrangements, other activities or limitations imposed by resort authorities including ski-lift, ski school and ski hire operators.

viii)  We reserve the right to terminate the holiday of an individual within the party whose behaviour (in the opinion of Ferme du Ciel) is considered to be inappropriate or unacceptable.

  1. Property Damage – Catered Guests.

The client or any member of the party is responsible for any damage so caused to the building or its contents.  In the event of such damage, we shall be entitled to recover from you at the time, the cost of repairs or replacements of any damage or loss caused by you or any member of your party.  Should you fail to do so, by default you will indemnify Ferme du Ciel against any claims (including Legal costs) subsequently made against us as a result of your action.

  1. Property Damage – Self Catered Guests

You are responsible for ensuring that the accommodation is left in a clean and tidy condition. Damage to fixtures and fittings is to be brought to our immediate attention for repair action. Replacement of breakages must be sought prior to vacating the premises. Where this is not possible, a refundable deposit of 1.000 € (one thousand euros) taken at the time of booking, will be returned within 2 (two) weeks of departure, less costs incurred for cleaning or damage not reported or paid for. Should the condition of the accommodation be unsatisfactory or there be an inventory discrepancy, you should contact us immediately.

  1. Cancellation – By Ferme du Ciel.

In the unlikely event that due to circumstances beyond our control, we have reason to cancel your booking, all monies received from you will be refunded in full.  Where the cancellation or alteration is due to forces beyond our control; such as war, fire, floods, strikes, riots, natural disaster, political unrest, dieses or any other circumstances amounting to Force Majeure, we will not entertain claims for compensation.

  1. Cancellation – By ‘The Client’.

Should you have to cancel your booking, the ‘Lead’ name whose signature appears on the booking form must immediately inform us in writing. Upon receipt of written notification, the following cancellation charges apply:

  • 8 weeks or more prior to arrival Loss of deposit
  • Within 8 weeks prior to arrival 100% of the Total Price
  1. Complaints.

i) Any complaint(s) regarding your holiday with us must be made immediately whilst in or on the premises, stating the cause of complaint. We will endeavour, if possible, to remedy your complaint as soon as possible.

ii) Should your complaint regarding your holiday with us either not be made at the time or, if made, not be remedied to your satisfaction, a written complaint must then be submitted within 14 (fourteen) days or departure. Any evidence to substantiate your claim must also be included.

iii)  Any written complaint will be responded to within 28 days from receipt of complaint.

  1. Smoking and Pets

Ferme du Ciel adopts a ‘No Smoking’ policy throughout the premises.  Additionally, Ferme du Ciel does not accept pets, unless with prior agreement by the owners.
